Introduction

This Privacy Policy describes how Layer 4 (Pty) Ltd, trading as Hyper Layer ("Hyper Layer", "we", "us", or "our"), collects, uses, and discloses information when you use hyperlayer.net and our client portal at billing.hyperlayer.net (together, the "Service"). It works alongside our POPIA Statement, which is the authoritative statement of your rights as a data subject under South African law — where the two overlap, the POPIA Statement governs.

By using the Service, you agree to the collection and use of information as described in this Policy.

Who We Are

Hyper Layer is a trading name of Layer 4 (Pty) Ltd, a company registered in the Republic of South Africa, providing game server hosting, web hosting, VPS, email hosting, and domain registration services.

Information We Collect

Account information. When you register an account or place an order, we collect your full name, email address, physical and postal address, contact number, and any other information you provide during registration or support interactions.

Payment information. We do not store your card number, CVV, or other sensitive card data on our servers. Card payments are processed directly by our third-party payment gateway providers, and card data is entered and stored exclusively on the gateway's secure systems. We only retain a payment token issued by the gateway, used to facilitate recurring billing, which cannot be used to reconstruct your card details. If you request an EFT refund or an affiliate payout, we collect banking details (account holder name, bank name, branch code, account number) via a support ticket.

Usage data. We automatically collect certain information when you visit the Service, including your IP address, browser type and version, device information, the pages you visit, and the time and duration of your visit. We log the IP address of all client area logins for account security purposes.

Support and communications. We retain the content of support tickets and other communications you send us in order to assist you and maintain a record of your account history.

Cookies and Similar Technologies

We use cookies for essential site functionality (such as keeping you logged into the client area) and for a small number of analytics and affiliate-tracking purposes. Full details of every cookie category we use, including our analytics providers, are set out in our Cookie Policy. We do not use cookies for third-party advertising.

How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service, including provisioning and managing your hosting services
  • Process orders and payments, and manage billing
  • Communicate with you about your account, invoices, support tickets, and service-related notices
  • Maintain the security of your account and our infrastructure, including fraud prevention and abuse detection
  • Understand how the Service is used so we can improve it, using the analytics tools described in our Cookie Policy
  • Comply with our legal obligations, including tax, financial record-keeping, and POPIA requirements

How We Share Your Information

We share information with third parties only where necessary to operate the Service or where required by law:

  • Payment gateway providers, to process card payments
  • Diamatrix (Pty) Ltd t/a domains.co.za, our upstream domain registrar, and the applicable domain registry (ICANN, ZACR, or other registry operator), for domain registrations — see our Domain Policy for details
  • Infrastructure and analytics providers that help us run and understand the Service, as described in our Cookie Policy
  • Regulators, courts, or law enforcement, where required by South African law or a valid legal process

We do not sell your personal information to third parties.

International Data Transfers

Some of our infrastructure and service providers operate outside South Africa. Where your information is transferred outside South Africa, we take reasonably practicable steps to ensure it continues to receive a level of protection substantially equivalent to that required under POPIA.

Data Retention

We retain your information only for as long as necessary to provide the Service, comply with our legal obligations, or resolve disputes. Full retention periods for each category of information are set out in our POPIA Statement.

Security of Your Data

We take reasonable technical and organisational measures to protect your information, including access controls, encryption where appropriate, and two-factor authentication where enforced. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Children's Privacy

Our Service is intended for use by individuals eighteen (18) years of age or older, in line with our Terms of Service. We do not knowingly collect personal information from anyone under the age of eighteen (18). If you believe a minor has provided us with personal information, please contact us so we can remove it.

Our Service may contain links to third-party websites, including our upstream registrar, payment gateways, and infrastructure providers. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies directly.

Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by an updated "Last Updated" date at the top of this page. We encourage you to review this Policy periodically.
